Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of TripFund’s websites, dashboards, fundraising pages, and related services (the “Service”). By creating an account or using TripFund, you agree to these Terms.
If you use TripFund on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
User Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.
Notify us promptly at hello@tripfund.io if you suspect unauthorized access. We may suspend accounts that appear compromised, abusive, or in violation of these Terms.
Organization Responsibilities
Organizations using TripFund are responsible for the accuracy of trip details, fundraising claims, participant communications, compliance with applicable fundraising and travel laws, and obtaining any required consents or waivers.
Organizations must not use TripFund for unlawful, misleading, or fraudulent fundraising. TripFund is a technology platform and is not the organizer of your trip unless expressly stated in a separate written agreement.
Donations
Donations made through TripFund are gifts to the designated fundraiser or organization campaign, not purchases from TripFund (unless an optional tip is involved).
TripFund facilitates donation checkout and related records. The receiving organization is responsible for how donated funds are used in accordance with its stated purpose and applicable law.
Payment Processing
Payments are processed by Stripe. By making or receiving payments, you also agree to Stripe’s terms where applicable.
Unless otherwise stated for a specific product, TripFund covers standard Stripe card-processing fees on supported donation transactions so organizations can receive the full donation amount (excluding any optional donor tip to TripFund). Stripe fees on tips, platform fees, or other charges may be handled differently as described in our Payment Processing & Payout Policy.
Optional Donor Tips
Donors may be shown optional tip options (including percentage presets and a custom amount). Tips are voluntary contributions to TripFund that help keep personal fundraising free.
Tips are separate from the donation. Organizations receive 100% of the donation amount on supported transactions.
Group Trip Fees
Group trips include the first 10 travelers at no platform fee for the organization, then $5 per additional traveler withheld from that traveler's trip-payment transfer to the organization, as described on our pricing page. Travelers are never charged a TripFund platform fee as a line item. Personal fundraising pages remain free. Group platform fees are separate from optional tips.
Intellectual Property
TripFund and its branding, software, design, and documentation are owned by TripFund or its licensors and are protected by intellectual property laws. You may not copy, modify, or reverse engineer the Service except as allowed by law.
You retain rights to content you upload. You grant TripFund a non-exclusive license to host, display, and process that content as needed to operate the Service.
User-Generated Content
You are responsible for content you post, including fundraiser stories, photos, updates, and organization materials. Content must not infringe others’ rights, contain malware, or be unlawful, harassing, or deceptive.
We may remove content or restrict access when we reasonably believe it violates these Terms or creates legal or safety risk.
Account Termination
You may stop using TripFund at any time. We may suspend or terminate access for violations of these Terms, prolonged inactivity, nonpayment of platform fees, fraud risk, or to protect users and the Service.
Provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will survive termination.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIP FUND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that fundraising goals will be met.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIP FUND AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM FEES AND TIPS YOU PAID TO TRIP FUND IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise.
Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms, except where applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top of this page will change when we do. Continued use of TripFund after changes become effective constitutes acceptance of the updated Terms.
If changes are material, we will provide additional notice when reasonable (for example by email or in-product notice).
